1 Introduction & Acceptance of Terms

Welcome to Pata Ticket! These Terms & Conditions govern your use of our website and services for purchasing event tickets in Kenya and internationally.

By accessing or using Pata Ticket, you agree to be bound by these Terms. If you disagree with any part, you may not use our services. These Terms apply to all visitors, users, and others who access the service.

Important: These Terms form a legally binding agreement between you and Pata Ticket. By creating an account or purchasing tickets, you confirm you accept these Terms.

2 Definitions

For clarity in these Terms:

  • User: Any person who accesses or uses Pata Ticket services.
  • Organizer: The entity or individual hosting an event and selling tickets through our platform.
  • Ticket: A digital or physical pass granting entry to a specific event.
  • Event: Any concert, festival, conference, or gathering for which tickets are sold on our platform.
  • Platform: The Pata Ticket website, mobile applications, and related services.

3 Eligibility & User Accounts

To use Pata Ticket, you must:

  • Be at least 18 years old, or have parental consent if between 13-17 years
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized account use

You are responsible for all activities under your account. We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4 Ticket Purchase & Payment Terms

When purchasing tickets:

  • All purchases are final unless otherwise stated
  • Payment must be completed in full at time of purchase
  • We accept various payment methods including M-Pesa, credit/debit cards, and bank transfers
  • Ticket availability is not guaranteed until payment is confirmed
  • Prices are subject to change without notice until purchase is complete

5 Pricing, Fees & Taxes

Ticket prices on Pata Ticket may include:

  • Face value set by the Event Organizer
  • Service fees for platform maintenance and development
  • Payment processing fees
  • Any applicable taxes (VAT, etc.) as required by Kenyan law

All fees will be clearly displayed before you complete your purchase. You are responsible for any currency conversion fees your bank may charge for international purchases.

6 Ticket Delivery & Usage

Tickets purchased on Pata Ticket are typically delivered:

  • Digitally via email with a unique QR code
  • Through the Pata Ticket mobile app
  • Occasionally as physical tickets for select events

You must present your ticket for entry at the event. Tickets are generally non-transferable unless the Organizer allows transfers through our platform. Reselling tickets above face value may be prohibited and could result in ticket cancellation.

7 QR Code & Ticket Validation Rules

Each ticket has a unique QR code for validation:

  • QR codes can only be scanned once for entry
  • Screenshots or printed copies may not be accepted - use the original digital ticket
  • Tampered or duplicated QR codes will be rejected
  • Organizers may require ID matching the ticket name for certain events

If your QR code fails to scan, event staff will verify your purchase through alternative methods at their discretion.

8 Prohibited Activities & Fraud Prevention

You agree not to:

  • Use automated bots to purchase tickets
  • Create multiple accounts to circumvent purchase limits
  • Sell counterfeit or invalid tickets
  • Use stolen payment methods
  • Harass other users or Organizers
  • Attempt to hack or disrupt our platform

We monitor for fraudulent activity and cooperate with law enforcement. Violations may result in account termination, legal action, and being banned from future purchases.

9 Event Changes, Cancellations & Refunds

Event details may change:

  • If an Event is cancelled, you will receive a full refund
  • If an Event is rescheduled, your ticket will be valid for the new date, or you may request a refund within 14 days of the announcement
  • If an Event is significantly changed (venue, headline act, etc.), you may be eligible for a refund
  • Refunds are processed to the original payment method within 7-14 business days

Organizers set their own refund policies for other circumstances, which will be displayed during purchase.

10 Organizer Responsibilities

Event Organizers using Pata Ticket must:

  • Provide accurate event information
  • Honor all tickets sold through our platform
  • Comply with all applicable laws and regulations
  • Provide safe and accessible venues
  • Handle attendee inquiries and issues related to their events

Pata Ticket acts as a platform connecting Organizers and attendees. We are not responsible for Organizer conduct, event execution, or venue conditions.

11 Platform Responsibilities & Limitations

Pata Ticket will:

  • Provide a secure platform for ticket transactions
  • Process payments efficiently and securely
  • Offer customer support for platform-related issues
  • Maintain reasonable platform uptime (excluding scheduled maintenance)

Pata Ticket does not:

  • Guarantee event quality or Organizer performance
  • Control venue conditions or event execution
  • Provide refunds for Organizer decisions (except as stated in Section 9)
  • Assume liability for personal injury or property damage at events

12 Intellectual Property

All content on Pata Ticket, including logos, designs, text, and software, is owned by or licensed to us. You may not:

  • Copy, modify, or distribute our content without permission
  • Use our trademarks without written consent
  • Reverse engineer or decompile our platform
  • Scrape or collect data from our site without authorization

You retain rights to content you upload, but grant us a license to display it in connection with our services.

13 User Conduct

You agree to use Pata Ticket responsibly:

  • Respect other users and Organizers
  • Do not post false, misleading, or harmful content
  • Comply with all applicable laws in Kenya and internationally
  • Do not interfere with platform operations
  • Report suspicious activity to our support team

14 Privacy Reference

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using Pata Ticket, you consent to our data practices as described in the Privacy Policy.

We may update our Privacy Policy periodically. Continued use of our services after changes constitutes acceptance of the updated policy.

15 Disclaimer & Limitation of Liability

Pata Ticket is provided "as is" without warranties of any kind. We do not guarantee:

  • Uninterrupted or error-free service
  • Accuracy of all event information (provided by Organizers)
  • Specific outcomes from using our platform

To the extent permitted by Kenyan law, Pata Ticket's liability is limited to the total value of tickets purchased in the 6 months preceding any claim. We are not liable for indirect, incidental, or consequential damages.

16 Termination & Suspension of Accounts

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent activity
  • Create risk or possible legal exposure for us
  • Do not use the platform for an extended period

You may terminate your account at any time by contacting support. Upon termination, your right to use Pata Ticket immediately ceases, but purchased tickets remain valid unless otherwise stated.

17 Governing Law & Jurisdiction (Kenya)

These Terms are governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.

If you are accessing Pata Ticket from outside Kenya, you are responsible for compliance with local laws. Our platform is designed to comply with Kenyan regulations while being accessible globally.

18 Changes to Terms

We may update these Terms periodically. When we make changes:

  • We will update the "Last updated" date at the top of this page
  • For significant changes, we may notify users via email or platform notifications
  • Continued use after changes constitutes acceptance of the new Terms

We encourage you to review these Terms regularly. The current version is always available on our website.
